"Proxy Studying" is Fraud: Your Training Shortcuts Could Lead to a Prison Sentence 

In the high-pressure world of adult social care, compliance is the heartbeat of the industry. However, a dangerous and illegal trend is spreading through the care sector including care homes and home care agencies, which is, "proxy studying", or "ghostwriting", or “I’ll do it for you”

This is the practice of an individual, whether a support worker or a Registered Manager, hiring or asking someone else to complete their mandatory e-learning, write their answers for their qualification assignments or assessment for Diplomas, or complete other compliance assessments on their behalf.

While some dismiss this unethical conduct as “a small thing” or "small shortcut" to manage a heavy workload, the reality is far more severe.

It is NOT a small thing. In the eyes of the law, this is Fraud. 

It is not a victim-less crime. 

In the eyes of the regulator, this is a safety crisis. 

For the perpetrator, it is a fast track to a criminal record.

To the Crown Prosecution Service (CPS), it is a fraud and economic crime, liable for prosecution under the Fraud Act 2006.


The "Perfect Storm" of Excuses

The care industry currently faces a set of challenges that some individuals use to justify criminal behavior.

1. "I don't have time to study."

  • The Excuse: Heavy rotas and administrative burdens leave zero "protected time" for learning.

  • The Reality: Competence cannot be "fast-tracked." Consider this: driving by car from London to Sheffield is roughly 165 miles. Even with no traffic, it takes at least 3 hours. You cannot "fast-track" that journey to 10 minutes unless you are lying about where you are. A "fast-track" certificate without the hours of study is simply a document that confirms a lie.


3. Turnover Pressures

  • The Excuse: "We need people on the floor now, so we just need the boxes ticked."

  • The Reality: An employer who encourages "ghostwriting" or “I’ll handle your training for you”, to fill a rota is letting a fraudster loose on vulnerable people. It is like “letting a fox guard a hen house”. It is a recipe for disaster for everyone, including other staff members. At worst it puts the organisation and Registered Manager at risk of a corporate manslaughter charge (and possible prison sentence), as well as immediate jeopardy of the organisation’s CQC registration.



The Ethical and Safety Implications: A Gateway Crime

When a worker uses a proxy to pass a safeguarding or infection control module, they enter the workplace unqualified. This is not a victimless crime.

  • Incompetence in Practice: If a worker hasn't personally studied fire safety or person-centered care or similar statutory requirements, they are dangerous. They cannot apply life-saving principles in a crisis because they never actually learned them.

  • The Fraudster in the Home: Cheating is an economic crime. More importantly, it is a gateway crime. If a person is willing to defraud a regulator and lie about their knowledge, skills, and/or qualifications, their fundamental integrity is compromised. An employer who allows this has effectively permitted a fraudster to access vulnerable clients who may then be subject to financial or material abuse.

  • Accomplice Liability: If a client is harmed and it is discovered the training was fraudulent, the Crown Prosecution Service (CPS) will not just look at the worker. The employer who "looked the other way" can be charged as an accomplice.


The Shortcuts are being Stopped

The authorities are tightening the net. If you are operating in the sector today, you must navigate three major regulatory shifts:

  1. DHSC Counter-Fraud Strategy (2023–2026): This strategy is now in full force. It is specifically designed to detect and prosecute fraudulent training activities within the NHS and social care sectors.

  2. The Expanded Care Workforce Pathway (Nov 2025): The pathway has grown to 8 distinct job categories (from New to Care to Registered Manager). The new rule is simple: you must prove you are competent in your current role category and all roles below your current role, before you can progress. Proxy studying makes this verification impossible.

  3. Strict CQC Documentation (Feb 2026): As of February 9, 2026, the CQC has introduced a "zero-tolerance" policy for registration applications. Providers must submit documentary evidence of business and administrative competence. Any application containing inaccurate, irrelevant, or "ghost-written" records will be automatically rejected.



The Risk to Your Career and Liberty

The consequences of proxy studying go far beyond losing a job:

  • Criminal Prosecution: Charges of Fraud by False Representation under the Fraud Act 2006 carry the very real possibility of a custodial (prison) sentence.

  • Permanent Barring: You will likely be added to the DBS barred list, preventing you from ever working with vulnerable adults or children again.

  • Loss of Standing: Any qualifications you did earn honestly may be revoked due to the discovery of fraudulent activity elsewhere.
